This website is owned and operated by HoneyBe Botanics, LLC., dba HoneyBe Botanics (herein referred to as the “Company”, “Seller”, “we”, “us”, or “our” in this agreement.) The Terms in this Policy set forth the terms and conditions under which you (the “Buyer” or “Customer”) may use our website, services, and products (may collectively be referred to as “the/our service”). By accessing or using the website of our service, you affirm that you have read, understood, and agree to be bound by these Terms.

 

These terms and conditions apply to all sales by HoneyBe Botanics, whether online, in person, or by phone or email. You, the Buyer, agree that the terms and conditions in effect and posted on this website on the date an order is placed will govern the sale.

 

Right to Change and Modify Terms 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the terms in a material manner, we will notify you that material changes have been made to the terms. Your continued use of this website or our service after any such change constitutes your acceptance of the new terms. If you do not agree to any of these terms or any future version of the terms, do not use or access (or continue to access) the website or the service.

 

Who Can Use Our Service

In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. We only sell and ship products within the continental United States, and our website is intended for users who abide in the United States. As such, we follow the regulations of the United States. If you are visiting our website from another country, please note that the laws where you reside may be different, and we may not comply with those laws.

 

Key Terms of Purchasing

When purchasing from us, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. You agree to provide current, complete, and accurate purchase and account information for all purchases made from us. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, in order for us to complete your transactions and contact you as needed.

 

Delivery

The Company will arrange for and prepay shipment of the products consistent with any specific delivery option selected by you, and you will pay all shipping and handling as specified during the ordering process. You are responsible for all aspects of unloading and storing of all product upon delivery. We are not responsible for any damage to product caused by heat or other adverse conditions that affect the product after delivery. If the product is damaged during the shipping process, the shipping company must be contacted directly to file a claim, and we will provide any information we have available to help you accomplish that. Any shipping or delivery dates given by us are approximate, are provided only for your convenience, and are conditioned upon the prompt supply of all necessary information by you, prompt payment by you, the ready availability of raw materials, normal labor relations, and customary times for manufacture. We are not liable for any delay in delivery of any kind, regardless of the cause or extent. All sales are contingent on the ability of our Company and its suppliers and/or manufacturers to secure associated products and raw materials.

 

Requests to change the shipping address after an order has been placed will not be accepted without cancelling the original order and replacing it with an order that provides the accurate shipping address. If the order has already shipped out, re-routing the package may be possible, but is not guaranteed. You may contact us during normal business hours to determine if cancelling an order or re-routing the package is possible.

 

Orders that are lost, stolen, or damaged during transit may be eligible for replacement once the situation has been thoroughly investigated. If the order has been stolen after delivery, please follow up with the shipping carrier to initiate this process.
 

Returns and Refunds

All products sold on our website are non-returnable, non-refundable, and not eligible for exchange. In the event a product has manufacturing defects or is materially defective or damaged, you may submit a request to us in writing by email, postal mail, or through our website contact form within 14 days of purchase to request a refund or replacement. In the event of replacement, the Company will be responsible for shipping costs of replacement.

 

Right to Changes

We may, without prior notice, change our services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Promotional Communications

We will ask for your permission before sending you promotional emails or texts. You are responsible for any fees or expenses occurred as a result of receiving promotional emails and/or texts. If you agree to receive promotional emails and/or texts from us, you may withdraw consent at any time by notifying us by email, postal mail, or through our website contact form. 

 

 

Intellectual Property

The service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of HoneyBe Botanics, LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works thereof.

 

Right to Suspend Access

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to products, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

 

Indemnification

You agree to indemnify and hold HoneyBe Botanics harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products or services offered on the website.

 

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall HoneyBe Botanics be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement

To the maximum extent permitted by applicable law, HoneyBe Botanics assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of the secure servers in which our customer information is stored and/or any and all personal information stored therein.

Preference of Law and Dispute Resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the service, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Texas, United States, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Hood County, Texas. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

  • Wix.com Ltd.- Our website is hosted on the Wix.com platform, which allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases, and the general Wix.com applications. They store your data on secure servers behind a firewall. All direct payment gateways offered by Wix.com and used by HoneyBe Botanics adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. Children’s Online Privacy Protection Act

HoneyBe Botanics does not knowingly collect, use, sell, or share the personal information of children under the age of 16. Children under the age of 16 should not send us any personal data, including email addresses. If you are under the age of 16 and would like to contact us, please ask your parent or legal guardian to contact HoneyBe Botanics for you. We care deeply about the online safety of children and ask that parents supervise children while online and on our website.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Return & Refund Policy

We want you to be completely happy with your product, but due to safety concerns, we cannot take returns on personal care products. If you receive damaged or defective items, please contact us within 14 days of receipt of the products for assistance.

 

If you are unhappy with your products, please contact us to provide feedback and receive assistance.

 

If you need to cancel an order after it has been placed, please contact us immediately. If it is during normal business hours and your order has not been filled, we may be able to cancel and refund your payment, minus any payment processing fees involved with the transaction. If your order has already been shipped, it cannot be cancelled.

Shipping Policy

All orders ship during normal business hours. We do not ship on weekends or holidays. We will do our best to ship orders within 48 hours of receiving them, and will notify you of any delays that may arise on our side.

 

We ship via USPS Priority Mail because of the sensitivity of our products to heat. We will never allow your package to be exposed to extreme temperatures, but we cannot control what happens once it is delivered. If you will not be present to accept delivery during warm weather, please consider shipping to an alternate location to prevent your package from getting too hot and melting the contents. We are not liable for and will not replace products that have been damaged by weather or other adverse conditions after delivery.

 

If you need expedited or special shipping, please contact us by phone or email to ask about availability.

 

Shipping estimates are approximate and are out of our control once the products leave our facility. Please make sure to allow plenty of time for your order to arrive.

 

We only ship to the continental United States.

Do Not Sell or Share My Personal Data
